STANDARD TERMS AND CONDITIONS AND TERMS OF SALE
The terms below apply to all Customers who do not hold a customer specific contract.

SERVICE DESCRIPTION
Effective Date: The date that a customer first contacts Deutsches Protokoll to make a booking.
Services: Protocol, transport logistics and chauffeur services to Customers. Services may be provided directly by Deutsches Protokoll or by its Fulfilment Partners, all licensed by the relevant authorities and governing bodies. Services may also include any mobility services including but not limited to Meet and Greet Services, Tour Guides, or any other services provided from time to time.
Area of Operation: Deutsches Protokoll provides its services in Berlin / Germany only.
Charges: Clients / Customers will be charged the Tariff unless otherwise agreed on. Any additional fees as for example but not limited to gratuities, tolls, car parking, waiting time or local taxes (unless stated differently) will be in addition to the fare.
Term: The terms herein shall be valid and continue until terminated by either party.
Communication Channel: E-mail, Telephone.
Payment Terms: Unless Customers choose to pay by Credit Card, Customers will be invoiced, and the invoice must be settled within eight (8) days of the invoice date (unless otherwise agreed).
Limitation of Liability: Deutsches Protokoll’s liabilities, under or in relation to the Terms herein, are governed by the related Laws, Rules and Regulations of Germany.
Reporting: Deutsches Protokoll will provide any reasonable reporting relating to bookings made by a customer.
Assignment: The Customer may not assign, transfer, mortgage, charge, subcontract, declare a trust over a deal in any other manner with any or all its rights or obligations under these Terms without Deutsches Protokoll’s prior written consent.
DEFINITIONS
Account: means an account which has been opened by Deutsches Protokoll for a Customer and which is identified by a Confidential Account Number (“Customer Account Number”) allocated to the Customer by Deutsches Protokoll.
Additional Charges: means those charges payable by the Customer in relation to the Services as set out in the Service Description or as may be agreed between the parties from time to time.
Fulfilment Partner: means a carefully selected third party on whose behalf Deutsches Protokoll acts as a principal to provide the Services.
Annex: means the schedules attached to Terms.
Applicable Law: means all statues, statutory instruments, regulations, regulatory requirements, by-laws, ordinances, subordinate legislation, and any other laws which apply in any relevant jurisdiction from time to time.
Authorised Users: means all permitted users of the services as authorised by the Customer.
Booking: means a day any other than a Saturday, Sunday or public holiday in Germany, when banks in Germany are open for business and business hours shall be constructed as 09:00 AM to 05:00 PM on a business day.
Cancellation Fee: means the sum payable by the Customer for the cancellation of a Booking by the Customer, as set out in the Tariff.
Charges: means the charges payable by the Customer for the Booking in accordance with the Service Description and the price calculated in accordance with charge rates agreed between Deutsches Protokoll and the Customer and provided as a quote. Any additional services provided (change of destination, waiting time etc.) and any tolls, local taxes (unless stated separately) and parking and set down fees will form part of the charges that will be invoiced.
Chauffeur: means a professional chauffeur employed by Deutsches Protokoll or a self-employed chauffeur, or a Fulfilment Partner chauffeur arranged by Deutsches Protokoll.
Service: means a service delivered by Deutsches Protokoll or a Fulfilment Partner.
Communication Channels: means the methods available to make a Booking as set out in the Service Description.
Collection Address: means the address stated by the Customer at the time of making the Booking as the address from which the vehicle shall collect the Customer and any Passenger or the Goods.
Conditions: means the terms and conditions as amended from time to time.
Conditional Information: means all information (whether written, verbal or in some other form) disclosed to or obtained by one party (whether directly or indirectly) from the other party (whether before or after the acceptance and signing of these Terms), including all information relating to the other party and/or a Fulfilment Partner’s business, operations, systems, processes, products, trade secrets, know-how, contracts, finances, plans, strategies, current, former or prospective clients (together with any copies made of any the foregoing) and which information is marked as being confidential or might reasonably be assumed to be confidential, but excluding information which is available to the public, trivial or obvious.
Contract: means any written agreement signed between Deutsches Protokoll and the Customer.
Destination Address: means the address stated by the Customer at the time of making the Booking.
Force Majeure Event: means any circumstance not within a party’s reasonable control.
Good Industry Practice: means in relation to any undertaking and any circumstances, the exercise of that degree of diligence, prudence and foresight which would reasonably and ordinarily be expected from a reputable and experienced Provider of Services the same as or similar to the Services.
Intellectual Property Rights: means all data and information, design rights, copyright, trademarks, domain names, trade names, know-how and all pending applications for registration under relevant laws of any country.
Minor: means children of less then twelve (12) years of age.
Passenger(s): means the Customer and such persons who the Customer shall authorise and/or permit to make use of the services confirmed by Deutsches Protokoll.
Quoted Fare: means the fare provided by e-mail once the itinerary has been agreed on.
TERMS OF SALE
By booking a service with Deutsches Protokoll, the Customer and Passengers fully accept Deutsches Protokoll’s Terms of Service and Terms of Sale. Any terms to the contrary imposed by the Customer or the Passenger are inapplicable to Deutsches Protokoll without its prior written consent.
NOTICE:
To book and/or pay for a Service, the Customer must be an adult, must have the legal capacity to enter a contract and comply with Deutsche Protokoll’s Terms.
BOOKING REQUEST:
A request to book a service can be made by telephone, e-mail or by any other means approved by Deutsches Protokoll. When a booking is made by telephone, it must be confirmed in writing by e-mail.
QUOTES:
On the receipt of the Booking request, Deutsches Protokoll issues a quote based on the information provided by the Customer or Passenger. Any change in the information provided is likely to change the initial price of the Service.
BOOKING CONFIRMATION:
If the quote is accepted, the Customer must confirm the Booking in writing to Deutsches Protokoll. Receipt by Deutsches Protokoll of the Booking Confirmation constitutes the formation of the contract between Deutsches protokoll and the Customer.
LUGGAGE POLICY:
Deutsches Protokoll will not be held liable for any loss of luggage during or after the Service. Passengers are responsible for their personal belongings and Deutsches Protokoll will not be held liable for any loss or deteriation of such belongings.
VEHICLE CAPACITY:
The maximum number of passengers in the vehicle (including the chauffeur) must not exceed the maximum number of passengers mentioned in the technical specifications of the vehicle.
CHANGING AND CANCELLING BOOKINGS:
Requests to change or cancel bookings must be done in writing by e-mail.
DAMAGE:
Customers will be liable for any damage caused inside the vehicle by them or by the persons accompanying them in the vehicle.
SETTLEMENT, PAYMENT, HOW TO PAY FOR THE SERVICES:
Deutsches Protokoll accepts Visa and Master Card as well as bank transfers. When booking the Service, the Customer will be required to provide valid credit card numbers (including CVC) and the color copy of an official ID document with photo. Deutsches Protokoll accepts bank transfers to its bank account provided to the Customer on the time of confirmation of the Booking.
INVOICE:
Deutsches Protokoll will e-mail the Invoice to the Customer.
